Key Aspects of the Conveyancing Process

Pre-contract stage
The process begins with the buyer and seller entering into a legally binding contract, usually through an offer and acceptance. The buyer may conduct property searches, inspections, due diligence, and surveys to gather information about the property's condition and any potential legal issues.

Drafting and reviewing contracts
The contracts, including the sale agreement and other relevant legal documents, are prepared and reviewed by the parties' respective conveyancing solicitors or licensed conveyancers. These contracts outline the terms and conditions of the sale, including the purchase price, property boundaries, and any special conditions.

Property searches and inquiries
The buyer's representative performs various searches to investigate the property's legal status and any potential issues. These searches may include checking the land registry, local authority records, environmental searches, and other relevant information.

Mortgage and finance
If the buyer requires a mortgage to purchase the property, their representative liaises with the lender to ensure the necessary funds are available for settlement. This involves coordinating mortgage documentation and ensuring all financial aspects are in order.

Exchange of contracts
Once all the necessary checks and inquiries have been completed and both parties are satisfied with the terms, the contracts are exchanged. At this stage, the transaction becomes legally binding, and a deposit (usually a percentage of the purchase price) is paid by the buyer.

Settlement and post-settlement
On the agreed settlement date, the remaining balance is transferred from the buyer's account to the seller's nominated account. The seller vacates the property, and the buyer takes possession. The representative then handles the registration of the property transfer with the relevant land registry, updating ownership records.
